Your Capital Source Foundation / YourCapitalSource.com (“YCSF”) affirms God-given rights, freedom of conscience, and voluntary private association. These principles form the basis of this private membership notice.

Reservation of rights

YCSF expressly retains and reserves all of its rights, defenses, privileges, and remedies, without prejudice. YCSF asserts its right to challenge unlawful interference, object to improper disclosure demands, and seek judicial protection. Nothing in this notice is intended to waive any such right.

Private membership by agreement

Private membership rests on voluntary agreement. Membership requires separate written terms identifying the parties and their rights and responsibilities, with affirmative acceptance by YCSF and the member.

Clear notice and affirmative assent are central to the contract-formation analysis in Berman v. Freedom Financial Network, LLC, 30 F.4th 849, 856–858 (9th Cir. 2022) (PDF).

Associational privacy

YCSF asserts the freedoms of speech, belief, assembly, and association, together with the right to defend the privacy of protected association.

In NAACP v. Alabama ex rel. Patterson, 357 U.S. 449, 460–466 (1958) (PDF), the Supreme Court protected membership lists where disclosure threatened associational rights and Alabama had not shown sufficient justification.

In Americans for Prosperity Foundation v. Bonta, 594 U.S. 595, 608–619 (2021) (PDF), the Court invalidated California’s blanket collection of charities’ major-donor information. Disclosure requirements subject to exacting scrutiny must be narrowly tailored to a sufficiently important governmental interest.

Requests and enforcement

Requests for nonpublic association records should identify the requesting party, the records sought, and the legal basis for the request. YCSF expressly reserves the right to challenge a demand’s authority, scope, or burden and to seek protective orders, declaratory relief, and injunctions.
